Heard Sri Shujauddin, learned counsel for the petitioner and Sri Dharmendra Vaish, learned counsel for the respondent no.3.
The petitioner has filed this petition for the quashing of the order dated 07.05.2019 passed by the Additional District Magistrate (Finance & Revenue) under Section 14 of the SARFAESI Act.
Learned counsel for the petitioner states that so far the secured assets has not been sold/transferred, petitioner may be permitted to pay the entire amount due within a reasonable time.
According to the above order, as on date 18.11.2012, a sum of Rs.4,38,140/- was due and payable by the petitioner.
Sri Dharmendra Vaish, on the basis of instructions submits that as on date a sum of Rs.9,47,437/- is due and payable by the petitioner.
Learned counsel for the petitioner without disputing the said amount requests for fixation of installments for its payment.
In view of the aforesaid facts and circumstances, we dispose off the writ petition with a direction to the petitioner to deposit a sum of Rs.2,47,437/- within a period of one month from today and balance amount of Rs.7 lacs in seven equal installments of Rs.1 lac each payable from the months of October, 2019 till April, 2020.
In the event of default in the payment of any of the installments, the benefit of this order shall come to an end automatically.
