No one has put in appearance to press the writ petition.
The challenge is to the recovery certificate dated 18.12.2020 which is based on the decision of the RERA passed in the year, 2018.
There is no challenge to the order passed by the Real Estate Regulatory Authority.
The prayer in the writ petition are as under:-
"1) To issue writ order or direction in the nature of certiorari calling for records and quashing the Impugned Recovery Certificates (Annexure N0- 10).
2) To issue writ order or direction in the nature of certiorari calling for records and quashing the impugned orders (Annexure No.9).
3) To issue a writ order or direction in the nature of mandamus of directing the respondent not to coercive majors against the petitioners."
Considering the incomplete prayer in the writ petition and the fact that the petitioner has only challenged the recovery proceedings which is consequential in nature, we do not find any merit in the writ petition.
