JUDGMENT / ORDER

Heard Mr.V.Balakrishnan, the learned counsel appearing on behalf of the petitioner and Mr.S.C.Herold Singh, learned Government Advocate, appearing on behalf of the respondents.
2. The learned Government Advocate appearing on behalf of the respondents had submitted that, the rice in question is Public Distribution System rice as seen from the Quality Certificate, dated 29.10.2009.
3. However, the learned counsel appearing on behalf of the petitioner had disputed the statement made by the learned Government Advocate appearing on behalf of the respondents.
4. Considering the fact that orders have been passed by this Court in various writ petitions, including an order, dated 09.10.2009, made in W.P.Nos.10161 and 10162 of 2009, the first respondent is directed to return the rice bags to the petitioner, if they have not already been disposed of or sold, till date, and if no other legal impediment exists, on the petitioner furnishing immovable property security to the entire quantity of the seized rice, at the rate of Rs.35/- per kg. Such immovable property given as security shall be situated in Madurai District.
5. Accordingly, the Writ Petition is disposed of, with the above directions,. No costs.
