Heard Mr. Pandya, learned advocate for the applicant.
2. The applicant has prayed for below mentioned reliefs in present application:-
"9(A) restrain the respondent authorities from filling up the vacant post of Deputy Secretary till the final disposal of the main petition, and/or (B) direct the respondent authorities not to fill up the vacant post of Deputy Secretary without first considering the case of the petitioner for promotion on the post of Deputy Secretary, and/or (C) further be pleased to direct the respondent authorities to consider the case of the petitioner for appointment at the time of filling up the post of Deputy Secretary, and"
2.1 The applicant herein is the writ petitioner in Special Civil Application No.15684 of 2011 wherein the petitioner has raised issue about his promotion to the post of Assistant Secretary.
2.2 The writ petition is pending at notice stage. In the meanwhile, the applicant - writ petitioner has come out with present application.
3. It is necessary to mention that the union has taken out application being Civil Application No.3328 of 2012 with request that the said union may be permitted to join the proceedings since the union wants to point out that the applicant - writ petitioner does not possess requisite qualification for being promoted to the post of Assistant Secretary.
4. Having regard to the aforesaid facts and circumstances, any ex-parte relief cannot be granted at this stage. Therefore, below mentioned directions are issued.
4.1 Notice returnable on 14.6.2012.
