(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Heard learned advocate Mr.M.A.Kharadi for the applicant-appellant. The present application is filed praying for suspension the sentence imposed vide judgment and order dated 12.4.2012 passed in Sessions Case No.129 of 2010 by the Hon'ble Court of Sessions, Dahod.
Learned advocate for the applicant - appellant submitted that the appeal is admitted on 7th May, 2012.
Taking into consideration the recent conviction and taking into consideration the fact that he has sentenced under Section 307 of Indian Penal Code to undergo 7 years R.I. and also for 1 year for offence under Section 504 of Indian Penal Code and 3 years for offence under Section 25(1)(A)(B) of Arms Act, the application is not entertained at this stage.
At the request of learned advocate for the applicant, it is clarified that it will be open for him to file application after lapse of some time preferably by the time the paper book is prepared.
