Madras High Court|15 September, 2017

JUDGMENT / ORDER

By Order dated 08.08.2017, passed in Crl.M.P.No.1888 of 2017, anticipatory bail was granted to these petitioners and the petitioners were directed to report before the respondent police daily at 10.00a.m. for a period of 30 days. Since the petitioners are residing in Kerala, they were finding it difficult to sign before the Mettupalayam Police Station, They moved a petition in C.M.P.No.2093 of 2017, seeking modification of the condition imposed on them since the same was dismissed, they have filed the present petition.
2. The only ground on which the petitioners seek for modification of the condition is that they were residents of Kearla and they were unable to sign before the Mettupalayuam Police Station daily at 10.00a.m.
3.Learned Additional Public Prosecutor on instructions would submit that the petitioners were complying with the condition for a period of 8 days and that they may be directed to appear before the respondent police instead of Inspector of Police, Mettupalayam Police Station.
4. Taking into account the submissions made, this Court is inclined to relax the condition imposed on the petitioner. Hence, the order passed in Crl.M.P.No.1888 of 2017 is modified to the effect that the petitioners shall appear before the respondent police as and when required for interrogation.
With the above observations, this Criminal Original Petition stands ordered.
