The petitioner submits that he has approached the District Collector, Thrissur with Ext.P3 application for issuance of no objection certificate to level the land of the petitioner and remove the excess earth from the property in terms of the provisions under Rule 5(7) of the Kerala Minor Mineral Concession (Amendment) Rules, 2012. The District Collector, Thrissur refused to accept the same and directed the petitioner to approach the Revenue Divisional Officer. The District Collector being the authority to consider the said application. I am of the view that the District Collector, Thrissur shall accept the application and pass appropriate orders. There shall be a direction to the District Collector to accept Ext.P3 and pass appropriate orders thereon within a period of three weeks from the production of the copy of the judgment. Petitioner is directed to produce the copy of the judgment before the District Collector, Thrissur for compliance.
