O.S. No. 357/2011 on the file of the court of the Munsiff of Irinjalakuda is a suit filed by the petitioner against the respondent for injunction simplicitor. O.S. No. 12/2013 on the file of the court of the Subordinate Judge of Irinjalakuda has been filed by the respondent against the petitioner for recovery of possession. Both the suits are in relation to the same property and it is only proper that they are heard by one and the same court.
2. The order transferring O.S. No. 357/2011 from the court of the Munsiff of Irijnjalakuda to the court of the Subordinate Judge of Thrissur calls for no interference. It is for the transferee court to decide as to whether a joint trial or a simultaneous trial of the two suits should be had or not.
3. Moreover the petitioner has not impleaded all the parties to the order in TOP No. 658/2013. The Original Petition has no merit and deserves to be dismissed therefore.
