ORDER:
This Writ Petition is filed for a mandamus to declare the action of the respondents in not appointing the petitioner as fair price shop dealer in place of her father on compassionate grounds as illegal and arbitrary.
In the counter-affidavit filed on behalf of the respondents, it is inter alia stated that the petitioner being a married daughter of the deceased fair price shop dealer, she is not entitled for being considered and appointed as fair price shop dealer as per G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28-2- 2014.
Having regard to this stand taken in the counter- affidavit, Mrs. Bhavana Rao, learned counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition, with liberty to her client to file a fresh Writ Petition questioning G.O.Ms.No.4, dated 28-2-2014.
The Writ Petition is accordingly dismissed as withdrawn in terms of the prayer made.
As a sequel to the dismissal of the Writ Petition, WPMP No.40693 of 2014 filed for interim relief is disposed of as infructuous.
