...Respondent HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.685 of 2014 JUDGMENT: (per Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta ) We have heard the learned Counsel for the parties and have gone through the impugned judgment and order of the learned single Judge.
We are of the view that the fact-finding of the learned single Judge is correct, as the appellant/writ petitioner cannot challenge the impugned tender notification basing on earlier contract, which will come to an end by 31st March 2014. We, however, clarify that the judgment and order of the learned single Judge will not prevent and prejudice from bringing civil action, if permissible under law and advised.
Accordingly, the Writ Appeal is dismissed. Pending miscellaneous Petitions, if any, shall also stand closed. No order as to costs.
