Common Order:
AS.No.184 of 2004 arises out of judgment and decree, dated 11-07-2003, in OS.No.239 of 2001, on the file of the Court of the learned I Additional Senior Civil Judge, Kakinada.
ASMP.No.1440 of 2014 is filed to pass a compromise decree in the aforesaid appeal by recording the terms and conditions mentioned in the Memorandum of Compromise annexed thereto.
In the affidavit filed in support of the aforesaid application, it is stated that on the intervention of mediators, the parties have settled the dispute by entering into a Memorandum of Compromise and that the same is signed by both the parties and their respective Counsel on 24-07-2014.
Both the appellant and the respondent are personally present and to the query put to them by the Court, they have stated that they have entered into the memorandum of compromise with their free will and consent.
In view of the above, ASMP.No.1440 of 2014 is allowed and Memorandum of Compromise, dated 24-07-2014, is taken on record. Consequently, AS.No.184 of 2004 is disposed of in terms of the said Memorandum of Compromise. Registry shall draft the decree in AS.No.184 of 2004 as per the Memorandum of Compromise.
As a sequel, miscellaneous petitions, pending if any, stand disposed of.
