High Court Of Kerala|23 October, 2014
|

JUDGMENT / ORDER

Application filed under Section 439 of the Code of Criminal Procedure.
2. Petitioner is the accused in Crime No.600 of 2014 of the Thrissur Town East Police Station registered for the offences punishable under Sections 379, 465 and 468 r/w Section 34 of the Indian Penal Code.
3. The allegation against the petitioner is that on 24.08.2010 at about 10.30 p.m., he along with other accused committed theft of a Hero Honda Passion Plus motor cycle belongs to the de facto complainant from the compound of the Thrissur Co-operative Hospital and thereafter, they fabricated and changed the engine number and chassis number of the motor bike and also changed the registration number and sold the same. The petitioner was arrested on 21.03.2014.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. Presently final report has been filed in the matter and the case is pending as C.C.No.2273 of 2014 before the
B.A.No.7318 of 2014
2 Judicial First Class Magistrate's Court-I, Thrissur. It seems that the learned Sessions Judge has directed the trial court to expedite the trial of the case and dispose of the same within a time frame. It has been report that the petitioner is a habitual offender involved in three other similar theft cases.
6. Considering his involvement in other cases and the fact that presently this case stands posted for evidence on 29.10.2014, I am of the view that any further interference in the impugned order passed by the learned Sessions Judge is required. The petitioner is not entitled to be enlarged on bail. By once again reminding the trial court to comply with the direction passed by the learned Sessions Judge this application is dismissed.
