Heard learned A.G.A. for the State.
The present appeal is against the Judgement of conviction and order of sentence dated 13.03.1984 passed by learned Special Judge, Mainpuri in Special Trial No. 30 of 1983 whereby sentencing the appellants to undergo for life imprisonment for the offence under Section 396 I.P.C.
Vide earlier order of this Court dated 12.01.2018, the concerned Chief Judicial Magistrate was directed to ensure the presence of the accused appellant by the next date and if the appellants are not surviving, the Chief Judicial Magistrate concerned was directed to hold proper enquiry as per the circular of this Court and to submit its report by the next date of listing.
Office report dated 27.02.2018 shows that the enquiry was conducted by the concerned Chief Judicial Magistrate , who sent a letter dated 19.02.2018 which is on record intimating therein that the appellants in the present appeal has since expired.
In view of above, the present appeal dismissed as abated.
