Heard learned counsel for the petitioner and Shri Diwakar Singh, learned counsel appearing for the Gaon Sabha.
This writ petition has been filed seeking the following relief:-
"(I) Issue a writ order or direction in the nature of Mandamus directing the respondent no. 2 Sub Divisional Officer, Tehsil Soraon, District Allahabad to decide the case of the petitioner bearing no. 327/365 of 2006 (Jokhai Ram vs. Gaon Sabha 7 others) under Section 41 of the U.P. Revenue code, 2006 in pursuance to the restoration application of the respondent no. 5 dated 10.06.2010 which is pending before the respondent no. 2 expeditiously within the stipulated time subject to the pending decision of the instant writ petition."
It has been submitted that the proceedings for demarcation instituted by the petitioner has not been finalized on account of pendency of a recall application of the contesting respondents filed in the month of June 2010.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2 Sub Divisional Officer, Tehsil Soraon, District Allahabad to decide the restoration application of the respondents as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
