The petitioner purchased a property covered by Ext.P1 patta from the legal heirs of the holder of patta. Ext.P1 is dated 27.12.1988. In Ext.P1 patta, there is a prohibition from alienating the property for a period of ten years. According to the petitioner, the petitioner has purchased this property as per Ext.P2 on 21.1.2008. The petitioner thereafter approached the Revenue Officials to effect mutation. The Revenue Officials refused to act upon effecting mutation citing the Government Order prohibiting alienation of Government land assigned under the Land Assignment Act. The Government Order prohibiting alienation to assign land is not applicable in the matter as petitioner is only bound by the conditions in Ext.P1 patta. Therefore, there shall be a direction to respondents 2 and 3 WP(C).No.30503/2014-K.
2 to effect mutation based on Ext.P2 without any further delay, at any rate, within a period of four weeks.
Writ petition is disposed of as above.
