The petitioner is the owner of an excavator JCB bearing registration No.KL-08-AM-3079. The vehicle has been seized while levelling a land. The petitioner has approached this Court for release of the vehicle. It is submitted by the learned Government Pleader that reclamation of the land is done by some other vehicles and an investigation is going on. The JCB of the petitioner is not involved in any of the offences under the Kerala Minor Mineral Concession Rules. Considering the facts and circumstances of the case, I am of the view, the vehicle shall be released t o the petitioner on executing a simple bond. However, it is made clear that the respondents are at liberty to prosecute any person for commission of any offence in accordance with law and WP(C).No.29751/2014-T.
2 release of the vehicle will not stand in the way of authorities in proceeding against them including the petitioner. The vehicle shall be released to the petitioner forthwith.
Writ petition is disposed of as above.
