JUDGMENT / ORDER

The petitioner is the absolute owner of 2.5 cents of property in Survey No.12/19, 12/20 and 17/25 in Nelliyampathy Village. This is evident from Ext.P6 judgment. The petitioner has a claim against other extent of land. This Court in Ext.P6 judgment directed the petitioner to approach the civil court to establish his right in respect of other extent of land. As far as 2.5 cents of land is concerned, the dispute has become final in the light of Ext.P6 judgment. It is stated in Ext.P6 judgment, the Forest Department have no objection for effecting mutation in respect of 2.5 cents of land covered by Ext.P2 patta. The petitioner's grievance in the present writ petition is that even though he was earlier issued with possession certificate and basic tax receipt in respect of the above extent of property, the Village Officer is refusing to issue basic tax receipt and possession certificate. In view of WP(C).No.27675/2014-H.
2 the conclusion of the dispute in Ext.P6, I am of the view the petitioner is entitled to possession certificate and basic tax receipt in respect of 2.5 cents of land situated in the above survey number. Needful shall be done by the Village Officer within two weeks from the date of receipt of copy of this judgment.
Writ petition is disposed of as above.
