… Respondent (By Smt. Namitha Mahesh B.G., HCGP) This Criminal Petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Crime No.316/2017 of H.A.L. Police Station, Bengaluru, for the offence punishable under Section 302 of Indian Penal Code.
This Criminal Petition coming on for orders this day, the Court made the following:-
O R D E R This is the successive third petition filed by the petitioner-accused under Section 439 of Cr.P.C.
2. After hearing the learned counsel for the petitioner for some time, he seeks permission to withdraw the petition.
3. However, the learned HCGP appearing for the respondent-State submits that CW.2 is an eye witness who was staying along with the deceased. He has been examined before the Court below and he has fully supported the case of the prosecution.
4. The submission made by the learned counsel for the petitioner is placed on record permitting him to withdraw the petition.
Accordingly, petition is dismissed as withdrawn.
