The petitioner is working as empanelled Conductor in the 2nd respondent, on daily wage wages. He was engaged as empanelled Conductor on the basis that his name was included in the Rank List publised by the Public Service Commission, for regular selection to the post of Conductor in the 2nd respondent. It is mentioned that during the period from 2010 to 2012, for about 1½ years, he was not continuing as an empanelled Conductor due to chronic illness. However, from 10-01-2012 he was re-engaged. The petitioner seeks regularisation in the service of the 2nd respondent on the basis of Ext.P4 Government order, wherein the Government had permitted regularisation of identically situated persons. The petitioner had submitted Ext.P7 request before the 2nd respondent seeking regularisation in service on the basis of Ext.P4 order. Since the said request is not considered, this writ petition is filed.

2. Heard; Standing counsel appearing on behalf of respondents 2 & 3. Since the 2nd respondent has not taken any decision on the claim made by the petitioner seeking regularisation, interest of justice will be achieved by directing an early disposal of Ext.P7 request.

Therefore the writ petition is disposed of by directing the 2nd respondent to consider Ext.P7 and to take an appropriate decision on the request made by the petitioner for regularisation in service, if necessary after affording an opportunity of personal hearing to the petitioner. A decision in this regard shall be taken at the earliest possible, at any rate within a period of 2 months from the date of receipt of a copy of this judgment.
