ORDER:
This writ petition is filed for a mandamus to declare the action of respondent No.4 in trying to seize the bore well dug by the petitioner over Ac.5.00 cents of land in Survey No.548-1 of Atmakur Village and Mandal, Anantapur District, without following the legal procedure, as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Revenue (Andhra Area), on instructions, submitted that the report received by respondent No.4 from the subordinate authorities revealed that the petitioner has dug the bore well without permission as envisaged under the A.P Water, Land and Trees Act, 2002 (for short ‘the Act’) and that proceedings will be initiated under the said Act for closure of the bore well.
In view of the above submission, the Writ Petition is disposed of with a direction to respondent No.4 not to interfere with the bore well of the petitioner unless appropriate proceedings under the Act have been initiated and the petitioner is given an opportunity of being heard.
As a sequel to disposal of the writ petition, W.P.M.P.No.905 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
