The petitioner has filed this writ petition seeking the following reliefs: (I) Issue a writ of mandamus or any other appropriate writs, orders of directions commanding the respondents to permit the petitioner to fix number plates in his vehicles bearing registration Nos.KL-63A/9 and KL-63B/4545;
(II) Declare that by virtue of Exhibits P1 to P3, the appointment of the petitioner as a Honorary Consul to the Democratic Socialist Republic of Srilanka in Thiruvananthapura, the petitioner is entitled to use number plates in his vehicles as provided under Rule 76 (8) of the Central Motor Vehicle Rules.
(III) Grant such other reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case.
2. The petitioner claims to be a person who has been appointed as the Honorary Consul of Srilanka in Thiruvananthapuram for the State of Kerala. It is contended that in view of Sub Section 8 of Rule 78 of the Central Motor Vehicles Rules, the petitioner is entitled to have the number plates of two of his vehicles written in white letters in black -2-
W.P.(C). No. 15691 of 2014 background indicating that he is also the Honorary Consul of the Country represented by him.
3. The learned Government Pleader points out that the petitioner has not submitted any application for the purpose, nor has any authority rejected any such request. Therefore, the petitioner has no cause of action to seek the reliefs prayed for in this writ petition.
4. Heard. I notice that, neither has the petitioner sought for the exercise of the privilege if any that he has been conferred with under the Rules as claimed, nor has any authority denied to him any privilege that is available to him in his capacity as Honorary Consul. Therefore, I do not find any ground to admit this writ petition or to grant any of the reliefs sought for.
This writ petition is therefore, dismissed.
