JUDGMENT / ORDER

The petitioner filed this petition under 482 of Cr.P.C., seeking a direction to the learned District Munsif cum Judicial Magistrate, Natham, Dindigul District, to conduct trial in C.C.No.45 of 2009 and C.C.No.49 of 2011 simultaneously and to dispose of the same in accordance with law.
2.The learned counsel appearing for the petitioner submitted that it is the case of case in counter and when notice was served on the petitioner by the first respondent police by referring the case in Crime No.91 of 2009 as mistake of fact, immediately, the petitioner filed a protest petition before the learned District Munsif cum Judicial Magistrate, Natham Taluk, Dindigul District and the said Judicial Magistrate treating the said petition as private complaint as C.C.No.49 of 2011 and dismissed.
3.The learned counsel appearing for the respondents 2 to 7 submitted that today the respondents 2 to 7 withdraw the Crl.O.P.(MD)No.10092 of 2011, which was filed to quash C.C.No.49 of 2011.
3.In view of the above, nothing survives for adjudication in this petition. Accordingly, the Criminal Original Petition is dismissed.
