J.Kothandaraman vs S.Ramya

Madras High Court|01 February, 2017

JUDGMENT / ORDER

This revision is filed by the husband/petitioner against the award of maintenance to the wife/respondent.
2.Heard both sides.
3.The HMOP was filed by the husband under section 13(1)(ia) of Hindu Marriage Act 1956 for dissolution of the marriage. The order impugned was passed on 06.07.2015 directing the payment of PUSHPA SATHYANARAYANA,J.
VRI Rs.7500/- per month against the claim of Rs.10,000/- made by the wife /respondent. It is now stated that subsequent to the filing of the revision in April, the O.P. itself was dismissed on 18.06.2016 for default and so far, no steps had been taken for restoration of the same. In fact, earlier this court as a condition had directed the revision petitioner to pay a sum of Rs.1,00,000/- which has already been complied with. As the main O.P. itself is dismissed, the revision automatically has become infructuous. Hence, the civil revision petition is dismissed as infructuous. It is open to the wife/respondent to take appropriate steps for maintenance in the manner known to law. No costs. The connected miscellaneous petition is also dismissed.
01.02.2017 vri To The Subordinate Judge, Ponneri.
