JUDGMENT / ORDER

The plaintiff has filed this civil revision petition to direct the Learned District Munsif, Coimbatore, to dispose of I.A.No.1967 of 2008 in O.S.No.1610 of 2008 on the file of District Munsif of Coimbatore, within a time frame fixed.
2. When the matter was posted for admission on 28.08.2009 and 11.09.2009, no representation for the petitioner. Today also there is no representation on behalf of the revision petitioner.
3.The suit is filed for declaration and permanent injunction against the defendants/respondents. Along with the suit, Plaintiff also filed I.A.1967 of 2008 praying temporary injunction. According to the revision petitioner the I.A. came up for hearing on 01.08.2008 and notice ordered to respondents 2 and 3 were served and notice to respondents 1 and 4 were returned as unclaimed. Inspite of steps taken to serve notice to respondents 1 and 4, they have not been served. In the meanwhile, according to the plaintiff/revision petitioner there is threat by the contesting respondents to evict the revision petitioner from the suit premises. There is an attempt to demolish the building and a police complaint was given on 19.06.2009. In this view of the matter this civil revision petition is filed to direct the trial Court for early disposal of the I.A.1967/2008.
4. Considering the limited prayer sought for, the Court below is directed to take up the I.A.No.1967 of 2008 in O.S.No.1610 of 2008 at an early date and dispose of the I.A.No.1967 of 2008 as expeditiously as possible. This civil revision petition is ordered accordingly. Consequently, connected miscellaneous petition is closed.
