In an identical facts and circumstances of the case, following orders have been passed in Writ Petition No. 11479 of 2019 on 1.8.2019:-
"Petitioner claims to be working as Collection Peon on seasonal basis since 1994. It is stated that in accordance with the Seventh Amendment introduced to the U.P. Collection Peons Regularization Rules, 2004, the claim of petitioner has been recommended for being regularized by the Additional Commissioner on 11.7.2014 and Deputy Commissioner on 5.11.2015, but no decision has yet been taken. Since his grievance has not yet been considered, therefore, petitioner is before this Court.
Learned Standing Counsel submits that petitioner's grievance shall be examined by the authority competent, in accordance with law, at the first instance.
In the facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent no.3 in respect of his grievance, noticed above, alongwith certified copy of this order, annexing all materials in support of his claim for regularization, within a period of two weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned and appropriate order would be passed, in accordance with law, within a further period of three months thereafter."
Grievance being similar on facts, this petition is also disposed of on same terms.
