(PER : HONOURABLE MR.JUSTICE VIJAY MANOHAR SAHAI) 1. We have heard Mr.Dipak Sindhi, learned counsel for the appellant and Mr.Varun Patel, learned counsel for the respondent.
2. This Letters Patent Appeal has been filed challenging the interim order granted by learned Single Judge on 6.4.2011 in Special Civil Application No.15948 of 2010.
3. According to the appellant, he was terminated from service on 26.8.1991. The award was made in his favour, directing reinstatement with 25% backwages on 29.6.2010. The writ petition has been admitted against the award filed by the respondent and award has been stayed, subject to compliance of Section 17-B of Industrial Disputes Act. The respondent is complying by Section 17-B of the Act, but the appellant is receiving only a meagre salary of Rs.1248.48 ps., in which it is very difficult for the appellant to meet both the ends. Learned counsel for the parties agreed that instead of deciding this appeal, the writ petition itself may be finally disposed of.
4. In view of the agreement of learned counsel for the parties, this appeal is disposed of with the request to the learned Single Judge to decide the aforesaid writ petition filed by the respondents expeditiously, subject to His Lordship’s convenience.
