Heard learned advocate for the applicant, Mr.AM.Dagli and learned APP, Mr.L.B.Dabhi, for the State.
It is submitted by learned advocate for the applicant that the applicant has been scrupulously observing all the conditions imposed by this Court. It is also submitted that applicant has to remain as a guest in the religious functions for the period from 19-6-2012 to 28-6-2012 and hence, sought to modify the condition No.6(6) of the order dated 29-2-2012 passed in Misc.Cri.Appln.No.1486 of 2012. It is further submitted that charge sheet has been filed since long.
This application has been filed for modification of condition No.6(6) imposed on the applicant while releasing the applicant on bail vide order dated 29-2-2012 passed in Misc.Cri.Appln.No.1486 of 2012 on the ground that the applicant has to enter into Juangadh district.
Respective conditions No.6(6) read as under:
"will not enter the city and district limits of Junagadh for the period of four months except for marking presence and attending trial."
It is to be noted that the aforesaid condition has been imposed for a period of four months and said period will be over within ten days and no untoward incident has been reported since his release on bail. Having regard to the facts and circumstances of the case and in view of the fact that the applicant has been scrupulously observing all the conditions imposed on him, condition No.6 (6) imposed on the applicant by this Court vide order dated 29-2-2012 passed in Misc.Cri.Appln.No.1486 of 2012 is deleted. All the other conditions imposed on the applicant in the order passed on 29-2-2012 passed in Misc.Cri.Appln.No.1486 of 2012 will remain unaltered. Rule is made absolute to the aforesaid extent. D.S. is permitted.
