Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 602 of 2017, under Sections 376(2) (Jha), 452, 328, 323, 506 IPC, and 4 Protection of Children from Sexual Offences Act (POCSO), P.S. Mahoba, District Mahoba, is seeking enlargement on bail during the trial.
Considering the fact that two witnesses of fact were examined and both of them turned hostile, the I.O. of the case is not cooperating in the the trial.
Learned trial court is directed to use all possible power, provided to him under the law to procure the attendance of the I.O. within a period of one months and make all necessary endeavour to conclude the trial by 30.09.2018 with the active support of both the parties.
With these observation the bail application is hereby rejected.
However it is made clear that in the event, if the trial is not decided within the period stipulated herein above, it is open to the applicant to approach this Court once again. and the learned trial court will have to explain reasons and circumstances for delay.
