Jithrabhai vs Javedkha

Heard learned advocate for the applicant and it is submitted that respondent No.1 is a driver and respondent No.2 is the owner of the Transport Company and are not necessary parties and further respondent No.3-Insurance Company is already served.

Considering the overall facts and circumstances, sufficient cause is shown on oath for delay in filing appeal and accordingly prayer is granted in terms of para 6 (A).

Rule is made absolute.
