JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Ms.Shah, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to take care of the treatment of his wife.
It appears from the jail report that his furlough has become due from February 2012.
Under these circumstances, the discretion does not deserve to be granted for temporary bail and, therefore, the application is not granted. Further, it is observed that the convict may apply for furlough and if such an application is made, the same shall be decided within one month and thereafter, if the conditions are complied with, the applicant - convict may enjoy the furlough.
Subject to the aforesaid observations, the present application is not granted. Disposed of accordingly. Rule discharged.
