(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through Jail seeking temporary bail for 45 days so as to get himself treated for the ailment of lungs he is suffering from. In the application it is specifically mentioned that for the last two years he is suffering from lung ailment and water retention and that therefore, he is not able to digest food and there is repeated vomiting and feeling of difficulty to breath. The Jail authorities have produced certificate issued by Medical Officer, Dr.H.C. Patel dated 1st June 2012, which is indicative of the fact that the convict is treated for heart ailment. Wherefrom the doctor has got the idea that the convict is suffering from heart ailment is not clear.
On the last occasion, viz. 15th June 2012, learned APP Mr.Pujari was granted time to produce latest health report of the convict. Now certificate under signature of Medical Officer, Dr.C.R. Makwana dated 16th June 2012 is produced. The latest certificate is verbatim identical of the previous one, except an addition of the following lines, "According to the reports suggest, he doesn't have any cardiac disease. The patient is better with the medicines and at present he doesn't have any complaint."
The above portion is underlined. Otherwise, the entire certificate is verbatim the same. This shows the sincerity with which the convicts are attended to by the Medical personnel.
In light of the above, the authorities are directed to keep the convict present before this Court at 11.00 AM on 20th June 2012. Medical Officers, Central Jail Dispensary, Ahmedabad, namely, Dr.H.C. Patel and Dr.C.R. Makwana shall also make it convenient to attend this Court at 11.00 AM on 20th June 2012. A copy of this order be made available to the learned APP for its onward communication.
