JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Learned APP Mr.Pujari tenders affidavits of Dr.C.R.Makwana and Dr.H.C.Patel, Medical Officers, Central Jail Dispensary, Ahmedabad. Taking into consideration the fact that Dr.C.R.Makwana had stated in para-8 that, ".....I say that I hereby tender my unconditional apology to the Hon'ble Court and assure that I will take due and propoer care of all the patients-prisoners and discharge my duty with utmost care and diligence........" and in view of the fact that Dr.H.C.Patel has also stated the same thing in para-8, this Court restrained itself from taking any further action in the matter.
Coming to the merits of the matter, Dr.H.C.Patel, has mentioned in para-7 as under:
"I say that on 22.6.2012 again the applicant-prisoner was referred to T.B. and chest disease department, Civil Hospital, Ahmedabad where he was examined by the Asst. Professor of Pulmonary Medicine Unit-II, considering his complaint, investigation was carried out and X-Ray of chest was taken and it was found that his lungs are normal and there was no water retention in the lungs. It was diagnosed that he was having problem of gastritis. Accordingly, doctors prescribed 15 days medicine to him".
The same thing is stated by Dr.C.R.Makwana in para-7, the present application is not required to be granted.
Learned APP, on instructions from both these doctors, stated that the applicant-convict will be given all required treatment with utmost care and caution. This application is rejected.
