Jitendrabhai vs Secretary

High Court Of Gujarat|21 June, 2012

JUDGMENT / ORDER

1. By way of this petition, the petitioner has prayed for compassionate appointment. The case of the petitioner is that that the petitioner's father Mr. Trikamlal was employed with respondent no. 2 and he expired on 29.05.1997. On 08.08.1997 the petitioner had applied for compassionate appointment with all relevant documents after fulfilling all required conditions as per prevailing policy of 1997 for grant of compassionate appointment but the said application came to be rejected by the respondent authorities on the ground of qualifications.
2. Counsel for the petitioner contended that the family of the petitioner is in a very pitiable condition and the application rejected by respondent authority on 2nd Augut 2005 is without authority. He submitted that the petitioner is now major and he has filed the petition seeking compassionate appointment within considerable period.
3. On the other hand, it is contended by the respondents that petitioner was living separately with his wife and he was not dependent on his father in any way at the time of his death and this fact was also admitted by the petitioner himself in his affidavit. Petitioner had also produced his own ration card.
4. Having heard learned counsel for the parties and perused the record, I feel that the petition has no merit and therefore, the same deserves to be dismissed. Hence, it is dismissed accordingly with no order as to costs.
