According to learned counsel for the applicant encroachments have been made on public utility land held by the concerned Gaon Sabha. Although a representation has been made to the Collector of the District, learned counsel for the applicant does not dispute that in terms of Section 67 of the U.P. Revenue Code, 2006 it is the Assistant Collector who stands conferred with the authority to undertake inquiries in this respect.
Consequently, this petition shall stand disposed of with the following directions:-
It shall be open to the applicant to approach the concerned Assistant Collector by way of a detailed representation in support of his allegation of encroachments having been made within a period of two weeks from today. In case such a representation is made the Assistant Collector shall have the same inquired into and if warranted initiate appropriate proceeding under Section 67 of the U.P. Revenue Code and proceed in the matter in accordance with law. The Court further provides that in case proceedings referable to Section 67 of the U.P. Revenue Code are initiated the same shall be concluded with expedition and preferably within a period of four months from the date of their institution.
