Heard Sri G.S. Chaturvedi, learned senior counsel assisted by Sri Anurag Shukla, learned counsel for the applicant and Sri Viresh Mishra, learned senior counsel assisted by Sri Sunil Kumar Yadav, learned counsel for the respondent.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 120 of 2016, under Sections 147, 148, 149, 364A, 341 I.P.C., Police Station Narkhi, District Firozabad.
It is contended by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case, therefore, he should be enlarged on bail. It is next contended that four witnesses have already been examined and the trial is in progress, therefore, a direction may also be issued to conclude the trial as early as possible.
Per contra, learned counsel for the respondent has vehemently opposed the bail application and informed that applicant is having criminal history. Therefore, no case is made out for granting bail.
Considering the facts that there are serious allegations against the applicant and the trial is in progress, there does not appear any good ground to release the applicant on bail.
The bail application is rejected.
However, keeping in view that the applicant is in jail since 08.03.2016, the trial court is directed to make an endeavour to conclude the trial expeditiously, if possible, within a period of six months from the date of production of certified copy of this order.
