Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
By means of this application, the applicant who is involved in case crime no.317 of 2017, under Sections 498A, 304B, 323, 504, 506, 326 IPC and Section 3/4 Dowry Prohibition Act, Police Station-Sonha, District-Basti, is seeking enlargement on bail during the trial.
Learned counsel for the applicant submitted that F.I.R. was lodged by the first informant, father of the victim against the applicant and four other co-accused persons. The applicant is the husband. As per FIR, the marriage of the daughter of the first informant was solemnized with the applicant in June, 2015. The allegation is that she was subjected to cruelty by the applicant and other family members for demand of motorcycle. Learned counsel next submitted that the trial is in progress and as many as five witnesses have been examined in the present case. The applicant is languishing in jail since 15.06.2017.
Under these circumstances, keeping in view the fact that five witnesses have been examined, I do not find any good reason to grant indulgence to the applicant at this stage.
Thus, the bail application stands rejected.
It is expected from the learned trial court to gear up the trial and made necessary endeavour to conclude the trial within six months from the date of production of certified copy of this order provided the applicant fully cooperates in conclusion of the trial.
Office is directed to transmit the copy of this order to the learned trial court within 15 days for intimation and necessary compliance.
