Heard learned counsel for the petitioner and learned Standing Counsel for respondents no.1 to 3.
Father of the petitioner was working as Driver in Public Works Department, Mathura. He died on 19.09.2018 during service period. The petitioner being son and dependent of late Chandra Prakash has submitted an application dated 13.10.2020 for compassionate appointment to the respondent no.3-Executive Engineer, Construction Department-I, Public Works Department, Mathura.
Grievance of the petitioner is that his representation has not been considered for compassionate appointment by the authority concerned.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with direction to the petitioner to file a fresh representation before the respondent no.3-Executive Engineer, Construction Department-I, Public Works Department, Mathura, raising all his grievances within a period of three weeks from today. In case any such representation is filed, the respondent no.3 shall consider and decide the same by a reasoned and speaking order within a period of three months thereafter.
With the aforesaid observations, the writ petition is
disposed of.
