Jitendra Srivastava vs Smt.Ranjeeta Srivastava & ...

High Court Of Judicature at Allahabad|22 May, 2012

JUDGMENT / ORDER

Learned counsel for the petitioner/husband states that a sum of Rs.1500/- is being paid to respondent-wife. Some documents are required to be filed, which would be necessary for adjudication of issue, therefore, the case be adjourned.
Learned counsel for the respondent-wife contends that because these proceedings are pending in context of an order passed under Section 125 Cr.P.C., the lower court is not allowing the respondent-wife to file an application under Section 127 Cr.P.C.
I find that no order has been passed by this court denying right of respondent-wife of filing an application under Section 127 Cr.P.C.
In that view of the matter, respondent-wife is at liberty to take recourse to remedies that are available in law.
List on 3rd week of July, 2012.
Order Date :- 22.5.2012 A.Nigam
