Heard Mr. Ravindra Prakash Srivastava, learned counsel for petitioner, learned Standing Counsel representing respondent 1 and Mr. Pankaj Kumar Gupta, learned counsel representing respondent 3 Gram Sabha.
Petitioner has filed present writ petition for a writ of mandamus commanding respondent 1 Tehsildar, Tehsil Harraiya, District Basti to decide Case No. 994 of 2017 Computerized Case No. T201717145301994 (Gaon Sabha Vs. Nagar Panchayat, Banhnan, under Section 67 of U.P. Revenue Code 2006, within a stipulated period of time fixed by this Court.
At the very outset, learned Standing Counsel and Mr. Pankaj Gupta, learned counsel for respondent 3 have jointly raised a preliminary objection by submitting that since petitioner is not a party to the proceedings under Section 67 of U.P. Revenue Code 2006, therefore, present writ petition is not maintainable.
When confronted with above, learned counsel for petitioner could not overcome the same.
In view of above, present writ petition fails and is liable to be dismissed.
It is, accordingly, dismissed.
