The challenge is to the order of suspension dated 28.04.2010 passed by the Assistant Regional Manager.
The submission of the learned counsel for the petitioner is that the appointing authority of the petitioner is the Board of Directors and the Board has delegated its power to the Regional Manager only. Therefore, the order passed by the Assistant Regional Manager is without jurisdiction.
Sri Vinod Ojha, learned counsel has accepted notice on behalf of the Respondents No. 1,2 and 3. He prays for and is allowed three weeks' time for filing counter affidavit. One week, thereafter, is allowed to the petitioner for filing rejoinder affidavit.
List thereafter.
Till the next date of listing, the operation of the impugned order dated 28.04.2010 shall remain stayed. However, the respondents shall be at liberty to pass a fresh order if considered necessary.
