Civil Misc. Recall Application No. 65355 of 2007 supported by an affidavit alongwith delay condonation application No. 65351 of 2017 dated 21.2.2017 are taken up.
Perused the affidavit filed in support of the delay condonation application. Sufficient cause has been shown. Delay is condoned and the delay condonation application is allowed. Perused the affidavit filed in support of the recall application. Sufficient cause has been shown. Accordingly recall application is allowed. The order dated 23.11.2016 dismissing the petition in default is recalled. The case is restored to its original number.
Heard Shri Amit Kumar Chaubey holding brief of Shri Yogesh Kumar Singh, learned counsel for the petitioner and the learned standing counsel for the State-Respondents.
The petitioner in the writ petition is seeking quashing of the orders dated 24.4.2007 and 13.3.2007 arising out of proceedings under the Indian Stamp Act, 1899.
An application alongwith an affidavit dated 28.3.2018 has been filed by the petitioner bringing on record the G.O. dated 10.1.2018 which provides that if the petitioner deposits the deficiency of stamp duty with interest within the time frame given with the token penalty of Rs.10/- then the penalty imposed by the stamp authorities shall stand waived. According to the petitioner he has already deposited half of the deficiency of the stamp duty.
Learned counsel for the petitioner, therefore states that he may be permitted to approach the State Government for seeking the benefit of this G.O. which is stated to be available only in the months of January, February and March, 2018.
This writ petition is therefore disposed of with liberty to the petitioner to represent to the State Government to claim the benefit if available to him under the G.O. dated 10.1.2018 providing for Samadhan Yojna on or before 31.3.2018 and the respondent no.1 shall decide the petitioner's representation within two months from the date of receipt of the same.
The impugned orders shall be subject to any final order which may be passed by the State Government.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
