Heard Sri M.R. Pandey, learned counsel for the applicant, Sri G.P. Singh, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is running a reregistration centre of Ayushman Yojna launched by Hon'ble Prime Minister. The applicant got print out 900 cards issued by the National Health Authority and 809 cards were already handed over to the respective persons and remaining 91 cards were kept in the shop of the applicant as their respective owners had not come to take the same, hence the aforesaid 91 cards were found in the shop of the applicant. He submits that due to pressure of News channel without any complaint of any person of the society, the opposite party no. 3 lodged the present F.I.R.
Learned learned A.G.A. has vehemently opposed the prayer for bail and submitted that there appears to be variation of age of the beneficiaries which shows that the applicant has been dealing in illegal activities for giving benefit of the scheme to unauthorized persons.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant Jitendra Rajpoot involved in Case Crime No. 228 of 2019 under sections 420, 467, 468, 471 I.P.C., police station Kotwali, District Pilibhit.
Accordingly, the anticipatory bail application is rejected.
However, the applicant will be at liberty to move regular bail application under section 439 Cr.P.C., if so advised.
