The writ petition has been filed seeking following relief.
• (i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 to decide the application dated 14.11.2018 (Annexure no. 6 to this writ petition) of the petitioner within a stipulated period which this Hon'ble court may deem fit and proper.
The application dated 14.11.218 filed by the petitioner seeks recall of an order passed by the Settlement Officer Consolidation on 1.11.2018 whereby the opposite party had been granted permission to raise constructions. This permission to raise construction was for a period of one month. The period of one month has admittedly expired on 1.12.2018.
Under the circumstances, petitioner's application has been rendered infructuous by efflux of time and for this reason, I do not find any justification for issuing the mandamus prayed for.
Subject to the above, the writ petition fails and is dismissed.
