Heard Sri M.D.Mishra, learned Advocate holding brief of Sri Sachida Nand Tiwari, learned counsel for the petitioner, Sri Rajiv Singh, learned Standing Counsel for the State respondents, Sri H.N.Tripathi, learned counsel representing respondents no. 3 and 4 and Sri Syed Nadeem Ahmad representing respondent no. 5.
In view of the order proposed to be passed, we do not deem it necessary to issue notice to the respondents no. 6 to 9 as their interest would be well protected in the direction issued by us.
Having considered the submissions, we dispose of this petition giving liberty to the petitioner to move a detailed representation before the respondent no. 4, the Regional Officer, U.P. Pollution Control Board, Regional Office, Allahabad, along with certified copy of this order and any other material which the petitioner deem fit in support of the representation whereupon the respondent no. 4 shall examine the same after due inquiry and pass a reasoned and speaking order in accordance with law within a period of two months from the date of receipt of certified copy of this order, after affording due opportunity of hearing to the petitioner and respondents no. 6 to 9.
