Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Present writ petition has been filed for issuance of mandamus commanding the respondent no.2 and 3 to consider the petitioner's representation dated 29.07.2020.
It is submitted by learned counsel for the petitioner that the majority of residents belong to Other Bakcward Class (OBC) and Scheduled Castes (SC) and therefore, in view of applicable policy, the seat of Pradhan should be reserved for OBC and SC candidate. It is next submitted by learned counsel for the petitioner that in this regard a representation has been filed by the petitioner before the District Magistrate as well as District Panchayat Raj Officer.
On being instruction received, learned Standing Counsel submits that till date, no notification has been issued reserving the constituencies regarding election of Pradhan and the same is in process.
No useful purpose would be served by keeping this writ petition pending.
Under these circumstances, a direction is issued to respondent no.2-District Magistrate, Maharajganj as well as respodent no.3-District Panchayat Raj Officer, Maharajganj to decide the petitioner's representation dated 29.07.2020, as expeditiously as possible, preferably within a period of two months from the date of production of computerized copy of this order.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
