Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Jitendra @ Jitu Chaurasiya who is involved in Case Crime No. 60 of 2018, under Section 21/22 NDPS Act, Police Station-GRP Kanpur Central, District-Kanpur Nagar.
As per prosecution version, on 30.1.2018 at about 2:20 AM, applicant was arrested by the police and recovery of 130 gram lorazepam powder has been made from him and he was implicated in other cases also.
Learned counsel for the applicant contends that there is no public witness of the alleged recovery and the applicant is in jail since 30.1.2018. He further contends that there is criminal history of 12 cases against the applicant and in all the cases, he is already on bail.
Learned A.G.A., has opposed the prayer for bail.
The alleged recovery of lorazepam powder is below the commercial quantity.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Jitendra @ Jitu Chaurasiya, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
Application stands allowed.
