Heard learned counsel for the applicant, Sri I.P. Srivastava, the learned A.G.A. for the State and perused the record.
The instant application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No. 90 of 2019, under Sections 323, 354 IPC, police station Adalhat, District Mirzapur.
It is not disputed and as is recorded in the order passed by the Sessions Judge, a proclamation under Section 82 Cr.P.C. has already been issued against the applicant. In view thereof and bearing in mind the decision of the Supreme Court in Lavesh v. State (NCT of Delhi) [(2012) 8 SCC 730], the Court finds itself unable to entertain this application, which shall stand rejected.
