Heard learned advocate Mr.R.C.Kakkad for the applicants on merits. He is pressing to take appropriate steps in view of the order dated 5.5.2008, whereas, learned advocate Mr.H.S.Tolia for the respondent No.2 is of the view that since the prayer is amended, considering prayer No.6BB, it is necessary to have papers of chargesheet on record, and without those papers, such relief cannot be granted.
Irrespective of rival contentions, considering the factual details on record, it would be appropriate to confirm the present status between the parties as well as Criminal Case No.431 of 2008, which was stayed by this Court s order dated 5.5.2008, more particularly, whether trial Court has taken any step to call upon the applicants original accused by serving summons or notices and by providing set of chargesheet to the applicants original accused.
Learned counsel for the complainant and for the accused to disclose on record about the present status of the dispute as well as of the complaint.
Learned A.P.P. to inquire from the Investigating Officer about the status of the criminal case and more particularly whether papers of chargesheet was supplied to the present applicants original accused in the present case. The matter is adjourned.
