JUDGMENT / ORDER

Petitioner submits that she is constructing a residential building in her property having a total extent of 31.24 cents situated in Survey No.178/8 of Chembu Village, Kottayam District. Petitioner approached this Court aggrieved by Ext.P4 stop memo issued by the Village Officer. Petitioner has been prohibited by the Village Officer from dumping any earth in the property. Petitioner points out Ext.P2 development permit issued by the Chembu Grama Panchayath. Petitioner submits that this property is not a paddy or wet land as per the draft data bank.
2. In view of the above, I am of the view, if the Village Officer has a case that the property of the petitioner is a paddy land or wet land, he shall report the same to the District Collector and District Collector will take appropriate action in the matter. Ext.P4 order of the Village Officer is set aside.
The Writ Petition is disposed of as above.
