JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. Petitioner is the 1st accused in Crime No.762/2014 of Kochi Cusba Police Station registered for the offences under Sections 452, 323,324,427 r/w S.34 of IPC.
3. The allegation against him is that he along with the co- accused armed with weapons like reapers trespassed into the shop room of the 1st informant, committed mischief therein and assaulted him and his wife. The loss caused to the 1st informant is about Rs.1,00,000/-.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The incident happened at 9.30 in the night. The loss caused to the 1st informant said to be Rs.1,00,000/- Prosecution has no case the victim sustained any serious injury. Having regard to these facts, I am inclined to grant the prayer of the petitioner.
In the result, this Bail application is allowed with the following conditions:
1) The petitioner shall be released on bail on his executing a bond for Rs.50,000/-(Rupees fifty thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this B.A. NO.4421 OF 2014 2 case.
2) He shall not consume alcohol while he is on bail, 3). He shall appear before the Investigating Officer at 10.30 a.m and 11.30.a.m on every Wednesdays for two months or till the final report is filed, whichever is earlier.
4) He shall not get himself involved in any criminal case while he is on bail.
In case of violation of any of the conditions the learned Magistrate is empowered to cancel the bail.
